1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Roamvero ("Service"), operated by Cygnus Digital Advertising Media Services OPC Private Limited (CIN: U74140PN2022OPC208226), a company incorporated in Pune, Maharashtra, India ("we", "us", or "our"). By creating an account or using Roamvero, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy.

2. Description of Service

Roamvero is an AI-powered travel itinerary generation platform. We use Google Gemini AI (operated by Google LLC) to create personalised travel plans based on your inputs. Our service includes:

• AI-generated day-by-day travel itineraries
• Hotel recommendations via Booking.com affiliate links
• Maps, directions, and navigation assistance
• PDF export and sharing features
• Saved trips and itinerary management

Roamvero does not offer a time-limited free trial. The Free plan includes a limited number of itinerary generations at no charge, with no payment required.

3. Subscription Plans and Payments

Roamvero offers the following subscription tiers. Prices vary by purchase platform:

iOS and Android subscriptions are billed in USD through the Apple App Store or Google Play Billing respectively. Web subscriptions (when available) will be billed in INR through Razorpay. Web subscription payments are not yet active — subscriptions are currently available via iOS App Store and Android Google Play only.

Auto-renewal: Monthly plans auto-renew each month until cancelled. The Elite Annual plan auto-renews each year until cancelled. By subscribing, you authorise recurring charges at the stated price until you cancel. Elite Annual plan subscribers will receive a renewal reminder email at least 7 days before each annual renewal date.

Billing descriptor: Charges will appear on your bank or card statement as ROAMVERO or CYGNUS DIGITAL. If you see a charge you do not recognise, please contact support@roamvero.com before disputing with your bank.

Prices are subject to change. We will provide at least 30 days' advance notice of any price increase to existing subscribers and will obtain your affirmative consent before applying the new price to your account, consistent with California Business & Professions Code §17602 and applicable auto-renewal laws. If you do not consent, you may cancel before the change takes effect.

4. AI-Generated Content Disclaimer

You acknowledge that:

• Itineraries are suggestions only and should be verified before travel
• Entry costs, opening hours, and prices may differ from actual conditions
• We are not responsible for decisions made based on AI-generated content
• Always verify visa requirements, travel advisories, and local regulations independently
• AI-generated content is not a substitute for professional travel or safety advice

4a. Apple App Store Billing Disclosure

For subscriptions purchased through the iOS App Store, the following applies in accordance with Apple App Store Review Guidelines §3.1.2:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the confirmed subscription price
• You can manage your subscription and turn off auto-renewal at any time by going to your App Store Account Settings after purchase: Settings → [Your Name] → Subscriptions → Roamvero
• Any unused portion of a free promotional period, if offered, will be forfeited when you purchase a subscription

4b. Google Play Billing Disclosure

For subscriptions purchased through the Google Play Store:

• Payment will be charged to your Google account at confirmation of purchase
• Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel your subscription at any time via: Google Play → Profile → Payments & subscriptions → Subscriptions → Roamvero → Cancel
• Google Play may automatically refund a subscription cancelled within 48 hours of purchase — see Google Play's refund policy for details

5. User Responsibilities

You agree not to:

• Use the service for any unlawful purpose
• Attempt to reverse engineer, scrape, or copy our AI systems
• Share your account credentials with others
• Use automated tools to access or abuse the service
• Submit false information or impersonate others

6. Intellectual Property

The Roamvero platform, including its design, code, branding, and AI systems, is our intellectual property. AI-generated itineraries created for you are yours to use for personal travel planning. You may not resell or commercially redistribute itineraries without our written permission.

7. Affiliate Links

Roamvero participates in the Booking.com affiliate programme. Hotel recommendation links in itineraries are affiliate links — clicking them and completing a booking may result in Roamvero earning a commission at no additional cost to you.

Roamvero does not guarantee hotel availability, pricing, or quality. All bookings are made directly with Booking.com and the property. Hotel links direct you to Booking.com search results for the recommended property — availability and pricing are controlled entirely by Booking.com and the property, not by Roamvero. This does not influence how hotels are recommended; recommendations are generated independently by AI based on your travel preferences.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Roamvero shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to travel disruptions, missed bookings, or losses based on AI-generated recommendations.

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

Statutory consumer guarantees: Nothing in these Terms limits rights you have under mandatory consumer protection law in your jurisdiction that cannot be excluded. In Australia, the Australian Consumer Law provides guarantees that cannot be excluded; our liability for a breach of such a guarantee is limited, to the extent permitted, to re-supplying the service or the cost of having the service re-supplied.

9. Cancellation and Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time through the platform where you subscribed:

• iOS (App Store): Settings → [Your Name] → Subscriptions → Roamvero → Cancel Subscription
• Android (Google Play): Play Store → Profile → Payments & subscriptions → Subscriptions → Roamvero → Cancel
• Web: Web subscription payments are not yet active. When launched, self-service cancellation will be available directly from your account dashboard, consistent with FTC Click-to-Cancel requirements. For any account queries in the meantime, email support@roamvero.com.

Upon cancellation, your access to paid features continues until the end of the current billing period. You will not be charged again after cancellation.

10. Governing Law

These Terms are governed by the laws of India. For disputes not resolved through arbitration under §10a, the parties consent to the non-exclusive jurisdiction of courts in Pune, Maharashtra, India.

10a. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or Roamvero shall be resolved by binding individual arbitration and not in a class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted under the rules of the Indian Council of Arbitration (ICA) or, for users located in the United States or Canada, under JAMS Streamlined Arbitration Rules. The seat of arbitration is Pune, India. Proceedings shall be conducted in English by a single arbitrator. Filing fees are capped at the equivalent of one month's subscription fee for the user's plan.

For users in jurisdictions where mandatory arbitration or class action waivers are unenforceable as a matter of law, disputes shall be resolved in courts of competent jurisdiction in Pune, Maharashtra, India, on an individual basis only.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification and will request your explicit consent before applying changes that affect how your data is processed or your subscription terms.
